Definitions

For the purposes of these Terms and Conditions:

Bank: Bank of Palestine PLC and any of its branches.

Customer: Any natural or legal person who is a customer of Bank of Palestine PLC and subscribes to the Online Banking Service.

Service: The Online Banking Service, which includes, but is not limited to:

  • Viewing accounts
  • Making internal transfers between accounts
  • Viewing bank information
  • Comparing exchange rates
  • Viewing online account statements
  • Paying bills
  • Viewing customer information
  • Requesting checkbooks
  • Making transfers between the Customer’s own accounts in different currencies
  • Viewing exchange rates
  • Viewing interest rates for foreign currencies against the local currency
  • Inquiring about the Customer credit facilities
  • Updating the Customer’s information, including address and telephone number
  • Email services
  • Changing the password

These Terms and Conditions governing the Online Banking Service constitute an important basis for the Customer’s understanding of the responsibilities and obligations arising from the use of the Service and the circumstances in which the Bank shall not be held liable. Accordingly, the following shall apply:

  • Although the Bank employs all available security measures to protect against the risks associated with the open nature of the internet, the Bank shall not be liable for any damage incurred by the Customer as a result of using the Service. The Customer alone shall bear all risks arising from the use of the Service.
  • The Bank provides the Service to the Customer. The Customer shall be responsible for providing and maintaining the equipment required to use the Service and for all related costs, expenses, and communication charges. The Bank shall not be liable for any defect in software used by the Customer, the Customer’s use of any additional software that may compromise the security or effectiveness of the Service, or the presence of viruses on the Customer’s device that may destroy or expose important data. The Customer alone shall bear all consequences arising therefrom.
  • The Bank shall provide the Customer with operating instructions containing detailed information about the Service, and the Customer shall comply with these instructions strictly.

  • · The Customer may submit a written request to the Bank, using the approved forms, to modify the services available to the Customer.
  • The Bank shall have the right to suspend the Service for the Customer at any time and for any period, without stating any reason and without incurring any liability. The Customer shall have no right to object to such suspension. The Bank shall notify the Customer of the suspension.
  • The Customer agrees that the Bank may use information relating to the Customer internally to provide the Customer with information about new services.
  • The Customer acknowledges having reviewed and understood how the Service operates and agrees that any guidance or information provided by the Bank is for guidance purposes only and shall not be binding upon the Bank. The Customer releases the Bank from any liability in the event of any disruption or interruption of the Service or any error in data obtained through the Service.
  • The Customer must change the password upon first logging in to the Service and shall bear full responsibility for safeguarding the user ID, passwords, and any other information provided by the Bank. The Customer shall keep all passwords confidential, store them securely, and exercise due care when using the Service in public places. The Customer releases the Bank from any liability for damages resulting from failure to comply with these requirements or from misuse of the Service.
  • The Customer fully understands that the user ID and passwords serve to identify the Customer. Accordingly, the Customer acknowledges that any transaction carried out using the Customer’s user ID and passwords shall be deemed to have been initiated by the Customer. The Bank shall consider any person using such credentials to be the Customer, and the Customer shall be responsible for all transactions carried out using the Customer’s identification credentials.
  • If the Customer requests one or more checkbooks through the Service, the Bank shall review the request. If the issuance of the checkbook(s) is approved, the Customer shall collect the checkbook(s) from the relevant branch. The Customer authorizes the Bank to debit any fees or commissions determined by the Bank for issuing the checkbook(s).
  • The Customer understands that transfers are processed automatically and immediately in accordance with the systems used to operate the Service where the transfer is between the Customer’s own accounts or between accounts held at Bank of Palestine branches, and the amount shall be credited to the relevant account.
  • The Customer agrees that the Bank shall not execute any transfer if sufficient funds are not available in the account at the time of the transfer or if the transfer amount exceeds the maximum daily transfer limit permitted under the Bank’s regulations and the instructions of the Palestine Monetary Authority.
  • The Customer authorizes the Bank to debit any commissions or fees determined by the Bank for each funds transfer or payment order, whether the transfer is between the Customer’s own accounts or to third-party accounts, as well as any commission for issuing a checkbook. The Customer further authorizes the Bank to debit the Customer’s account for any other expenses related to or arising from the transaction. The Customer shall be responsible for any obligations arising from entries made to the Customer’s account through the use of the Online Banking Service and for any error resulting from any transaction carried out through the Service.
  • The Customer releases the Bank from any liability if the Customer is unable to access the electronic services for any reason and acknowledges that the Bank has exercised due care in providing the available security, protection, and encryption measures to safeguard the electronic services provided.
  • The Customer acknowledges that all Bank records, including electronic records, are accurate, conclusive, and binding evidence and that the Customer shall have no right to object to or challenge such records.
  • The Bank and the Customer acknowledge that the email service provided through the Service constitutes a secure means of communication between them. Accordingly, electronic messages between the Bank and the Customer shall be exchanged exclusively through this Service, and the Customer shall be deemed to have received every message sent by the Bank through the Service.
  • If the Customer suspects that any person is accessing or tampering with the Customer’s account through the Service, or that the Customer’s user ID or passwords have been disclosed to another person, the Customer shall notify the Bank as soon as possible and subsequently confirm such notification in writing. The Customer shall remain responsible for all amounts arising from the use of the Customer’s user ID and passwords until the end of the day on which the Bank receives the Customer’s written notification.
  • The Service shall be temporarily suspended if the password is entered incorrectly three consecutive times, whether when logging in to the Service or when executing transfer transactions. In such case, the Customer must contact the relevant branch to reactivate the Service or follow any other procedures prescribed by the Bank.
  • The Bank shall have the right to change or amend the terms and conditions of the agreement after notifying the Customer in writing and/or electronically at the address registered with the Bank. Any such change shall become effective unless the Bank receives a written and/or electronic objection from the Customer within one week from the date the Customer receives the notification. The Bank shall also have the right to change the software used for the Service and the services provided without prior notice to the Customer.
  • The Customer acknowledges being aware of the risks associated with transferring funds from the Customer’s account to third-party accounts and of the applicable transfer limits, and acknowledges that a transfer shall only be executed after the password has been entered. The Customer further acknowledges that any transfer made through the Service shall be deemed valid and authorizes the Bank to execute such transfer immediately without further reference to the Customer.
  • The Customer acknowledges being solely responsible for any transfer made to third-party accounts and for any obligations arising from subscribing to and using the Service. The Customer shall be solely responsible for all actions carried out through the Service and waives the right to claim from the Bank any amounts transferred through the Service or to object to any transaction executed through the Service.
  • The Customer acknowledges that the mobile phone number serves as the means of authentication for the self-registration process and is the approved means for receiving the one-time password. Bank of Palestine does not permit the Customer to update or change the registered mobile phone number through any channel other than a branch.

  • The Customer understands and agrees that funds may only be transferred from the Customer’s account to beneficiaries who have previously been registered at a branch and for whom the Customer has signed the Bank-approved beneficiary registration documents.
  • The Customer acknowledges that the Bank shall bear no direct or indirect liability or responsibility for any obligation, loss, damage, or expense incurred by the Customer as a result of using the Service, particularly where such loss, damage, or expense relates to or results from any of the following:
  • Use of the Service through the internet or inability to use the Service.
  • Errors in execution, amendment, or cancellation, or any other error of any nature caused by the Customer, or the Customer’s inability to correct such errors.
  • Any transfers made from the Customer’s account to third-party accounts through the Service.
  • Delays in executing transactions for reasons beyond the Bank’s control, regardless of their source.
  • Criminal acts, including forgery, fraud, computer hacking, unauthorized access, network breaches, the use of passwords by hackers, loss of passwords, or any other methods.
  • System failure or interruption for any reason.
  • Any other matters determined by the Bank.
  • The Bank continuously develops the Service. The Customer shall be bound by all transactions executed through the Service, shall be deemed to have accepted its operating mechanisms, and shall bear responsibility for any errors that may arise.
  • The Customer acknowledges having no intellectual property rights in any software, screens, or documents provided by the Bank through the Service or subsequently developed by the Bank, and shall not permit any third party to:
  • Copy or modify any software or screens provided by the Bank.
  • Download or transfer any electronic banking software from one electronic device to another.
  • The Palestinian courts shall have jurisdiction over any dispute arising from or relating to the interpretation or application of these Terms and Conditions or the use of the Service. Both the Bank and the Customer waive their respective rights to exchange formal judicial notices.
